Terms of Service
These Terms of Service ("Terms") govern your use of parts.texas-ee.com (the "Site") and any purchase you make from Texas Equipment Emporium ("we," "us," or "our"), located at 3401 House Anderson Rd, Euless, TX 76040. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Products and fitment
We sell aftermarket replacement parts for forklifts and material handling equipment. Make, model and OEM part number information is provided to help you identify the correct part. Brand names and OEM part numbers are used for reference only. They do not mean that we are affiliated with, endorsed by or authorized by any equipment manufacturer.
You are responsible for confirming that a part is correct for your equipment before ordering and installing it. If you are unsure, contact us with your truck's make, model and serial number and we will help confirm fitment. Product images are for illustration and may differ slightly from the item you receive.
2. Pricing and availability
Prices are listed in U.S. dollars and may change without notice. We try to keep all pricing, descriptions and stock information accurate. If we discover an error in the price or description of an item you ordered, we will contact you and you may confirm the order at the correct price or cancel it for a full refund. We reserve the right to limit quantities and to refuse or cancel any order, including orders that appear to be placed by resellers without prior arrangement.
3. Orders and payment
Your order is an offer to buy. We accept your order when we ship it. Payment is due at checkout through the payment methods offered on the Site. You confirm that you are authorized to use the payment method you provide.
4. Taxes
Applicable sales tax is added at checkout. Tax-exempt customers must provide a valid exemption or resale certificate before ordering. Contact us to set this up.
5. Shipping
Shipping charges, delivery terms and timeframes are described in our Shipping Policy, which is part of these Terms. Title and risk of loss pass to you when the order is handed to the carrier.
6. Returns and refunds
Returns are handled under our Returns & Refunds policy, which is part of these Terms. A Return Authorization (RA) number is required for all returns.
7. Core charges
Some parts carry a core charge that is refunded when you return your old part on time and in rebuildable condition, as described in our Returns & Refunds policy.
8. Warranty
Parts are covered against defects in materials and workmanship as described in our Returns & Refunds policy. This coverage does not apply to damage caused by improper installation, misuse, accident, modification, lack of maintenance or normal wear.
EXCEPT AS STATED IN OUR RETURNS & REFUNDS POLICY, ALL PRODUCTS ARE PROVIDED "AS IS," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Installation and safety
Forklift parts, especially brake, steering, hydraulic, electrical and LPG fuel system components, should be installed only by a qualified technician following the equipment manufacturer's procedures and all applicable safety regulations, including OSHA requirements. You are responsible for the safe installation, inspection and operation of your equipment.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, DOWNTIME, LABOR COSTS OR EQUIPMENT RENTAL, ARISING FROM YOUR PURCHASE OR USE OF ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM.
11. Use of the Site
You agree not to misuse the Site, including by attempting to gain unauthorized access, scraping content in bulk, or interfering with its operation. Site content, including text, layout and graphics, may not be copied or reused for commercial purposes without our written permission.
12. Accounts
If you create an account, you are responsible for keeping your login details secure and for all activity under your account.
13. Privacy
Our Privacy Policy explains how we collect and use your information.
14. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Tarrant County, Texas.
15. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on the Site. Orders placed before a change are governed by the Terms in effect at the time of the order.
